1. INFORMATION FOR THE USER

Who is responsible for processing your personal data?

SEBASTIAN BRUGMANS S.L.U. is the Data Controller of the USER's personal data and informs you that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD).

For what purpose do we process your personal data and why do we do it?

Depending on the form through which we have obtained your personal data, we will process them confidentially for the following purposes:

PROFILE COLLECTION

Purpose and Legitimization of the Processing: To carry out a profiling process with the consent of the data subject, based on automated processing, aimed at evaluating the personal aspects specified in the CV provided by the data subject for inclusion in the recruitment processes of external companies designated by the Controller.
Anticipated Consequences: The processing of the data does not foresee consequences that may have legal or other effects that could significantly affect the data subject.
Logic Applied: The data is processed using an automated procedure in which all fields are filtered to obtain a result as close as possible to the requirements set by the companies involved in the candidate selection process.
Data Update: If your data changes, please update it immediately using the procedures provided for this purpose.
Data Retention Criteria: The data will be retained for a maximum period of one year from the last update. After this period, if the data is not updated, the information will be blocked in such a way that it will no longer be available to the companies. After three years without updating the information, the data will be deleted, ensuring total confidentiality both during processing and in its subsequent destruction.
Data Communication: The data may be communicated to external companies affiliated with the Data Controller for the execution of the employment contract and necessary training courses, or for legal reasons.
SERVICES

Purpose and Legitimization of the Processing: Provision of the requested services (as necessary for the execution of the contract involving these services, Art. 6.1.b GDPR) and sending communications related to products or services (with the consent of the Data Subject, Art. 6.1.a GDPR).
Data Retention Criteria: The data will be retained for no longer than necessary for the purpose of the processing or as required by legal prescriptions, and when the purpose is no longer needed, the data will be deleted with the appropriate security measures to ensure anonymization or total destruction of the data.
Data Disclosure: The data will not be disclosed to third parties, except for legal obligations or if necessary for the provision of the service.
Cross-border Data Transfers:
Data may be communicated to third parties to fulfill the purpose of processing or for legal reasons.
International Data Transfers: In accordance with Article 44 of the GDPR, authorization for the international transfer of data to a country not recognized with an adequate level of protection can only be granted if sufficient guarantees are provided. Therefore, it can be granted if the Data Controller provides a written contract, executed between the data exporter and the data importer, which includes the necessary safeguards regarding the privacy of the data subject and their fundamental rights and freedoms, ensuring the ability to exercise their respective rights.
Risks of Processing: I declare that I have been informed about the transfer of data to the provider of the services described (as per the attached contract) and that I have been clearly informed of the risks of processing due to the lack of adequate data protection guarantees in the recipient country.
How long will we retain your personal data?

The data will be retained for no longer than necessary to maintain the purpose of processing or as required by legal prescriptions. Once the purpose is no longer needed, the data will be deleted with the appropriate security measures to ensure anonymization or total destruction.

To whom do we disclose your personal data?

Data communication to third parties is not planned, except when necessary for the development and execution of the processing purposes, to our service providers related to communications, with whom the Data Controller has signed confidentiality and data processing agreements required by applicable privacy regulations.

What are your rights?

The rights of the USER are:

Right to withdraw consent at any time.
Right of access, rectification, portability, and erasure of your data, as well as limitation or opposition to its processing.
Right to lodge a complaint with the Spanish Data Protection Authority (www.aepd.es) if you believe the processing does not comply with current legislation.

2. OBLIGATORY OR VOLUNTARY NATURE OF THE INFORMATION PROVIDED BY THE USER

By marking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or download forms, USERS expressly and unequivocally agree that their data is necessary for the provider to attend to their request, voluntarily providing their data in the remaining fields. The USER guarantees that the personal data provided to the Data Controller is accurate and undertakes to inform them of any modifications to the data.

The Data Controller informs that all requested data through the website is mandatory, as it is necessary for providing optimal service to the USER. If all the requested data is not provided, it cannot be guaranteed that the information and services provided will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with current data protection regulations, the Data Controller complies with all provisions of the GDPR and the LOPDGDD for the processing of personal data for which it is responsible. It ensures compliance with the principles described in Article 5 of the GDPR, ensuring that data is processed lawfully, fairly, and transparently concerning the data subject, and is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

The Data Controller guarantees that appropriate technical and organizational measures have been implemented to apply the security measures established by the GDPR and LOPDGDD to protect the rights and freedoms of USERS, and has communicated the necessary information for them to exercise their rights and freedoms.
